Terms of Service

These Terms of Service ("Terms", "Agreement") are a binding agreement between Chris Houston ("we", "us", or "our") and you ("you" or "your") governing your use of the Idle Hobo mobile application and related services (collectively, the "App" or "Service").

By downloading, installing, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App. This Agreement should be read together with our Privacy Policy.

1. Age Requirement

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you are at least 13 years old. If you are under 18, you represent that you have your parent or legal guardian's permission to use the App and to make any purchases.

2. License to Use the App

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App for your personal, non-commercial entertainment on devices you own or control, as permitted by the applicable app store's terms.

You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, decompile, disassemble, or create derivative works of the App or any part of it, except where expressly permitted by law. You may not use cheats, exploits, automation software, bots, hacks, mods, or any unauthorized third-party software designed to modify or interfere with the App.

3. Intellectual Property

The App, including all content, graphics, characters, cards, artwork, audio, software, and other materials, is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws. You receive no ownership rights in the App or any virtual items. All rights not expressly granted are reserved.

4. Virtual Items, Cards, and Game Balance

The App includes virtual items such as cards, currency, boosts, and other in-game content ("Virtual Items"). Virtual Items are licensed to you as part of the Service, not sold. They have no real-world monetary value and cannot be exchanged for cash, refunded (except as stated below), sold, or transferred outside the App.

Game updates and balance changes. Idle Hobo is a live game that we update over time. We may, at any time and without prior notice or compensation:

• Change, rebalance, buff, nerf, add, remove, or replace cards, stats, abilities, drop rates, progression systems, rewards, or other gameplay mechanics.
• Adjust the difficulty, economy, or effectiveness of Virtual Items you have already obtained, whether earned through play or purchased.
• Modify or discontinue features, events, or content.

By using the App and acquiring Virtual Items, you acknowledge that gameplay is subject to ongoing change and that purchasing or obtaining a card or other Virtual Item does not guarantee its future stats, rarity, power, availability, or competitive standing. We are not obligated to maintain any Virtual Item at a particular level of strength or value, and balance changes do not entitle you to a refund, credit, or compensation.

We are not responsible for loss of Virtual Items due to device failure, account issues, uninstallation, or other causes outside our reasonable control. Where supported by the platform, progress may be tied to your app store account; you are responsible for maintaining access to that account.

5. In-App Purchases

The App may offer Virtual Items, premium features, or other content for one-time purchase through the Apple App Store or Google Play (each, a "Platform") ("In-App Purchases"). The following terms apply:

• Payment processing. All In-App Purchases are processed by the Platform. You agree to the Platform's terms and payment policies. We do not collect or store your payment card details.
• Pricing. Prices are shown in the App at the time of purchase and may vary by region or Platform. We may change prices or offerings at any time.
• Delivery. Virtual Items are delivered to your account or device upon successful payment confirmation by the Platform.
• All sales final. In-App Purchases are non-refundable, except where a refund is required by applicable law or expressly granted under the Platform's policies. We do not process refunds directly. Any refund request must be submitted to Apple or Google through the purchase channel you used.
• No transfer. In-App Purchases are tied to your Platform account as permitted by that Platform. You may not transfer, assign, trade, or share purchased Virtual Items with any other person or account.
• Minors. If you are under 18, you confirm you have parental or guardian consent before making any In-App Purchase.

By completing an In-App Purchase, you confirm that you authorize the charge and agree to these Terms.

6. Subscriptions

The App may offer an auto-renewing subscription ("Subscription") that provides access to premium benefits for a recurring period (e.g., weekly or monthly), as described in the App at the time of purchase. If a free trial is offered, its duration and terms will be shown before you subscribe.

The following terms apply to Subscriptions:

• Auto-renewal. Payment will be charged to your Platform account at confirmation of purchase. Your Subscription automatically renews unless you cancel at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the price shown in the App for that renewal term.
• Manage and cancel. You can manage, change, or cancel your Subscription at any time through your Apple App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period; you will retain access to Subscription benefits until then. Deleting the App does not cancel your Subscription.
• Free trials. If a free trial is offered, any unused portion is forfeited when you purchase a Subscription, where applicable. If you do not cancel before the trial ends, you will be charged the subscription price shown in the App.
• Benefits may change. Subscription benefits, features, and included Virtual Items may be modified, added, or removed over time. Continued use after changes constitutes acceptance of the updated benefits.
• Refunds. Subscription payments are handled by the Platform. Refund requests must be directed to Apple or Google in accordance with their policies. We do not process subscription refunds directly.

By subscribing, you agree to these Terms and the Platform's subscription terms.

7. Advertisements

The App may display advertisements provided by third-party ad networks (e.g., Google AdMob). By using the App, you agree that:

• Ads are supplied by third parties. We do not endorse or assume responsibility for advertised products, services, or content.
• Any interaction or transaction with an advertiser is solely between you and that third party.
• Ad networks may collect data to deliver and measure ads, as described in our Privacy Policy and the ad network's own policies. You may limit ad tracking in your device settings.
• We may change, limit, or remove advertising in the App at any time without notice.

8. Prohibited Conduct

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable law or regulation.
• Cheat, exploit bugs, manipulate game systems, or use unauthorized third-party tools to gain an unfair advantage.
• Attempt to gain unauthorized access to the App, our systems, or other users' accounts or data.
• Interfere with or disrupt the App or servers, including through viruses, malware, or denial-of-service attacks.
• Harass, abuse, or harm others, or post or transmit harmful, offensive, or illegal content.
• Infringe our intellectual property rights or the rights of others.
• Collect or harvest personal information of other users without consent.

We may suspend or terminate your access to the App, without refund, if we reasonably believe you have violated these Terms or engaged in conduct harmful to the Service or other users.

9. Service Availability and Changes

We strive to keep the App available but do not guarantee uninterrupted or error-free operation. The App may be unavailable during maintenance, updates, or events beyond our reasonable control. We may modify, suspend, or discontinue the App or any part of it at any time, with or without notice.

We may update these Terms from time to time. We will post the revised Terms on this page and update the date below. Your continued use of the App after changes become effective constitutes acceptance of the updated Terms. If you do not agree, you must stop using the App and cancel any active Subscription through your Platform account.

10. Disclaimer of Warranties

THE APP AND ALL VIRTUAL ITEMS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR FREE OF ERRORS, OR THAT ANY VIRTUAL ITEM OR GAME BALANCE WILL REMAIN UNCHANGED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE AND OUR LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, VIRTUAL ITEMS, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US THROUGH IN-APP PURCHASES OR SUBSCRIPTIONS IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) FIFTY U.S. DOLLARS (USD $50).

Some jurisdictions do not allow certain limitations of liability; in those cases, our liability is limited to the fullest extent permitted by law.

12. Third-Party Links and Services

The App may link to third-party websites or services. We are not responsible for their content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms.

13. Termination

You may stop using the App at any time. We may terminate or suspend your access at any time, with or without cause or notice. Upon termination, your license to use the App ends. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing provisions) will survive.
